02/13/2013 Bayer announces reports increase in Yaz and Yasmin sales while announcing Yaz Lawsuit Settlements. In a move typical of a major pharmaceutical manufacturer, Bayer agreed to Yaz lawsuit settlements that may total about 750 million in the US but refuses to admit wrongdoing, instead pushing forward with the sales of the popular oral contraceptives.

Yaz Lawsuits number in the Thousands

 

Bayer discloses information about Yaz lawsuit settlements and Yasmin lawsuit settlements in their Stockholder's Newsletter covering their financial report for the period ending September 30, 2012. The same newsletter announces the news that their oral contraceptives, Yaz and Yasmin while the subject of over 13000 Yaz lawsuits and Yasmin lawsuits remains among Bayer's top selling pharmaceuticals.

Bayer's disclosure to stockholders says "Claimants allege that they have suffered personal injuries, some of them fatal, from the use of Bayer's drospirenone-containing oral contraceptive products such as Yasmin™ and / or YAZ™ or from the use of Ocella™ and / or Gianvi™, generic versions of Yasmin™ and YAZ™, respectively, marketed by Barr Laboratories, Inc. in the United States. As of October 15, 2012, Bayer had reached agreements, without admission of liability, to settle the claims of about 3,490 claimants in the U.S. for a total amount of about US$750 million."

 

Yaz lawyers contend their clients have been seriously harmed by the extremely popular combined hormonal contraceptives (CHC).  For any Yaz lawyer that has filed a Yaz lawsuit on behalf of an individual that died while taking Yaz, the news that Bayer is continuing move forward with Yaz settlements is positive but the idea that the product remains a top producer for Bayer may make any Yaz lawyer's successes bittersweet.

 

 Yaz Side Effects Leading to Lawsuits

 

Are potentially deadly Yaz side effects and Yaz lawsuits just a blip on the radar for Bayer? Bayer's financial report for the period ending September 30, 2012 acknowledges the allegations made by claimants in Yaz lawsuits and Yasmin Lawsuits include the allegations they "suffered personal injuries, some of them fatal, from the use of Bayer's drospirenone-containing oral contraceptive products" but the report announces Yaz and Yasmin sales worldwide increased by 0.07% for the same financial period in 2011.

 

Yaz Recall Unlikely

 

Has there been a Yaz recall? There has not been a Yaz recall nor does it seem likely there will be. In fact, the manufacturer seems intent on further promotion of the oral contraceptives that may have been linked to so many serious injuries and reportedly is looking to emerging markets such as China as their next target rich environment for sales.

 

Will Yaz lawsuit settlements have a negative impact on the manufacturer? Individuals that were potentially injured by Yaz or Yasmin may endure long term, expensive inpatient care. Typically, a pulmonary embolism, heart attack or stroke (some of the reported side effects possibly associated with the use of Yaz), will require admission to an intensive care unit (ICU). Depending on the type of insurance coverage and the length of the stay in ICU a woman may be faced with a hospital bill she can't pay. Follow-up care could be ongoing leaving the potential victim to struggle with ever increasing, possibly insurmountable medical expenses. Medical debt can impact credit scores and quality of life.

 

Bayer meanwhile, even after announcing hefty Yaz settlements, has a healthy credit report, according to their Stockholder newsletter. Says Bayer's report "Standard & Poor's gives Bayer a long-term issuer rating of A- with positive outlook, while Moody's gives us a long-term rating of A3 with stable outlook. The short-term ratings are A-2 (Standard & Poor's) and P-2 (Moody's). These investment-grade ratings document good creditworthiness."

 

Is justice served? Injury can't be undone. Death is the ultimate finality. Both injury and death are among the allegations made by potential victims that filed Yaz lawsuits.  Potential victims that sought the help of a Yaz lawyer and filed a Yaz lawsuit may be entitled to financial compensation. Perhaps a positive outcome will offer solace to those suffering potentially irreparable harm.
